Is CBD in Canada legal?
We would love to say simply, CBD is legal in Canada, however, there are a few obstacles and conditions. In October 2019 recreational cannabis use was made legal under Canada’s Cannabis Act. However, there is still some confusion over what is legal and what is not. When you buy CBD oil derived from cannabis plants they will need to be produced by Health Canada approved licensed producers.
When you buy CBD oil it must be purchased from a licensed producer. If you purchase your CBD oil from a health food shop it may not be regulated for quality. You need to make sure you are buying your CBD oil from a trusted and licensed provider.
In October 2019 there is another change afoot. This change will render CBD edibles, beverages, extracts, topicals and concentrates legal.
Where can I buy CBD in Canada?
You can buy CBD from Licenced Providers which have been approved by Health Canada. You can also purchase your CBD online. However, when you buy online the CBD oil seller needs to be a Licenced Provider, approved by Health Canada.

Can hemp products can be imported?
You will be able to import other derivatives of hemp without a permit. However, they must have proper labelling, contain a certificate of analysis, show the levels of THC and be processed from specific elements of the plant. You must make sure you have clearance for your product so you don’t end up with a fine. We can provide a certificate of analysis for all of our hemp products. “ Derivatives of industrial hemp seed or viable grain (e.g. hemp seed oil), or derivatives of non-viable cannabis seeds, that do not contain any phytocannabinoids (including cannabidiol (CBD)) as specified under the Industrial Hemp Regulations (IHR) can be imported or exported without a licence or permit provided that the derivative or product is accompanied by a certificate of analysis from a competent laboratory in the country of origin of the derivative or product stating that the derivative or product contains a concentration of 10μg/g THC or less; the derivative or product has not been made from whole industrial hemp plants, including sprouts, or the leaves, flowers, or bracts of those plants; and in the case of the wholesale sale of a derivative, that the package containing the derivative is also labelled “Contains 10 µg/g THC or less – Contient au plus 10 µg/g de THC”.
